General terms and conditions (GTC) for booking workshops/events from Feelinature UG

1. Scope

1.1. These General Terms and Conditions (GTC) apply to the implementation of workshops and other events (hereinafter: “Event”) of the organizer Feelinature UG (hereinafter: “Organizer”) regardless of the venue of the booked event.

1.2. The following conditions govern the booking of the event.

1.3. The participant can only book accommodation directly with the specified hotel, which also bears sole responsibility for the contractual provision of all services associated with accommodation.

1.4. The organizer is solely responsible for the organization and implementation of the event and is not a tour operator or travel agent.

3. Offer, acceptance, conclusion of contract

3.1. The description of the event on the websitewww.feelinature.com represents a legally binding offer (offer).

3.2. Written registration via the participant's website constitutes acceptance of the offer and thus the conclusion of the purchase contract.

3.3. After accepting the organizer's offer by registering the participant, they will receive a registration confirmation by email. This email contains details of the order and payment, and the invoice can also be found in this email (order confirmation).

4. Storage of the contract text

4.1. The participant can read the organizer's terms and conditions on the websitewww.feelinature.com View “Terms & Conditions Events”. The document can be printed and viewed.

4.3. The contract text is saved by the organizer. This contract text is available to the participant upon request.

5. Payment of the fee

5.1. The participant books the event in writing with the organizer. The purchase price is due immediately upon booking. The prices stated on the website are final prices and include the currently applicable sales tax.

5.2. The invoice can be sent via Paypal. Credit card, bank transfer can be paid.

6. Rights and obligations of the participant

6.1. The participant is obliged to provide his personal data truthfully and completely. The participant undertakes to communicate changes to his data promptly.

6.2. The participant must meet the necessary requirements for participation in the event on his own responsibility and at his own expense. This applies in particular to booking transport, accommodation and meals.

6.4. Participation in the event requires normal mental and physical resilience. If the participant is undergoing medical or psychotherapeutic treatment, he or she is required to discuss participation with the doctor or therapist.

6.5. The participant is required to inform the organizer of any physical or psychological limitations or complaints before the start of the event.

6.6. The participant has no right to have the event carried out by specific teachers. In the event of a short-term, unforeseeable absence of the announced teacher, for example due to illness or incapacity, the organizer may provide a replacement teacher for the booked event. The replacement of the teacher does not entitle the participant to withdraw from the contract or to terminate the contract.

7. Rights and obligations of the organizer/minimum number of participants

7.1. The scope of the services to be provided by the organizer extends exclusively to the implementation of the event. The organizer does not provide or arrange any services in connection with the participant's arrival and departure as well as accommodation and meals.

7.2. The organizer is entitled to change the timing or content of the event or to omit individual components of it, provided that this does not change the aim and overall character of the event.

7.3. The organizer undertakes to inform the participant no later than two weeks before the start of the event that it cannot be carried out due to the minimum number of participants not being reached. In this case, the fee paid will be refunded immediately. The minimum number of participants is eight people.

7.4. If the minimum number of participants is not reached, the seminar hotel will allow the participant to cancel the separate booking of the hotel stay promptly and free of charge. The organizer is not obliged to reimburse the participant for cancellation or rebooking costs for transport and hotel services already provided.

7.5. The organizer reserves the right to postpone or cancel the event for reasons for which the organizer is not responsible. This is particularly the case if, if the announced teacher is unable to attend, for example due to illness, no other teacher can take over the event or if force majeure endangers or impairs the implementation of the event. The participant will then receive the course amount refunded immediately. The participant has no further claims.

8. No right of withdrawal for events

There is no right of withdrawal for consumers, Section 312g Paragraph 2 Sentence 1 No. 9 BGB. Booking an event is a service related to a leisure activity. According to Section 312g Paragraph 2 No. 9 BGB, there is no right of withdrawal for such services.

9. Cancellation by participants – cancellation costs

9.1. The participant can cancel the contract in writing to the organizer at any time before the start of the event. If the participant cancels the contract, the organizer can demand flat-rate compensation. The compensation will be calculated as a percentage of the course fee as follows after receipt of the participant's written cancellation notice:

  • Up to 4 weeks before the start of the course: 20% of the purchase price

  • Up to 1 week before the start of the course: 80% of the purchase price

 

9.2. The participant can provide a replacement participant until the start of the booked event, who will assume the rights and obligations of the contract.

10. Rights of withdrawal; Termination due to special circumstances

10.1. The short-term replacement of the announced teacher by the organizer does not entitle the participant to withdraw or terminate the course.

10.2. If the implementation of the event is made significantly more difficult, endangered or impaired by force majeure that was not foreseeable when the contract was concluded, both the participant and the organizer can terminate the contract. The rights and obligations of both parties arise from the legal regulations.

11. Liability

The organizer is not liable for third-party services, in particular for travel services or claims of participants from their contractual relationship with the seminar hotel. This also applies to any claims by participants as a result of a cancellation of their hotel booking after the event has been canceled by the organizer.

12. Declaration of consent in images and video recordings

12.1. The organizer reserves the right to use and publish images and video recordings during the event on its own website and in its own social media as well as to pass them on to cooperation partners (teaching staff, hotel, ...) for use and publication on their websites and in theirs social media for the purposes of advertising and describing the services.

12.2. The participant hereby declares his consent to images and video recordings of himself in accordance with Section 12.1. of these Terms of Use.

12.3. The participant can revoke his consent on site before the image and video recordings are made to the person taking the recordings.

13. Applicable law, place of jurisdiction

13.1. German law applies exclusively, excluding the UN Sales Convention on the purchase of movable property (CISG).

13.2. If the customer is a merchant, a legal entity under public law, a special fund under public law in Germany without a place of jurisdiction, Bad Kreuznach is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
